What to do after an accident
Steps to take in the hours and days after a personal injury, before evidence and memories fade.
After a serious injury, what you do in the first hours and days can shape the strength of any later legal claim. The steps below are a practical checklist — general information, not a substitute for talking with an attorney about your specific case.
- I
Get medical care
See a doctor or go to the ER, even if you feel okay. Many serious injuries — concussion, whiplash, internal injury — are not obvious right away. Medical records are also the foundation of any injury claim.
- II
Call the police and get a report
For vehicle crashes, always call the police. For premises incidents, ask the manager to file an incident report and request a copy. A written record of what happened is far more valuable than anyone’s memory later.
- III
Document the scene
Take photos of everything — the vehicles, the property, your injuries, the road, the weather, any warning signs (or missing ones). Get the names and phone numbers of witnesses before they leave.
- IV
Exchange information
Names, phone numbers, addresses, insurance information, license plates. For crashes, also driver’s license numbers and vehicle registration.
- V
Preserve evidence
Keep damaged property, torn clothing, the defective product that hurt you. Do not repair or discard. Keep receipts for medical visits, prescriptions, and travel for care.
- VI
Be careful what you say
Do not apologize or admit fault at the scene. Do not post about the accident on social media. Do not give a recorded statement to the other party’s insurance company before speaking with an attorney.
- VII
Track your symptoms and expenses
Keep a daily journal of pain, limitations, and how the injury affects your work and life. Keep every bill and receipt.
- VIII
Talk to a personal injury attorney
Call an attorney before accepting any settlement. Most offer the first call at no charge. Personal Injury Legal Centers can connect you with an attorney in your area 24/7.
Why these steps matter
Insurance companies start building their case against your claim the moment they are notified. Early statements, missing records, and un-photographed scenes are the gaps adjusters use to reduce or deny claims.
An attorney can help preserve evidence, handle communications with the insurer, and make sure your claim reflects the full extent of what you went through.
